A national chicken wings franchise is being sued by a former employee based on a hostile work environment. The Title VII race discrimination lawsuit asserts that the franchise fostered an environment that encouraged discrimination, including race discrimination, age discrimination, discrimination based on a disability and retaliation. Title VII of the Civil Rights Act of 1964 protects against employment discrimination and harassment based on race, sex, religion, and national origin. The Age Discrimination in Employment Act (ADEA) prohibits age related discrimination.
In this instance, the former employee asserted that restaurant managers made derogatory comments about African American customers, and routinely allowed employees to refuse service or provide poor service to African Americans. The former employee asserts that when he voiced his concerns about the discriminatory treatment, he faced retaliation, including being denied raises and promotions, and being required to take out the trash and clean floors, even though it wasn’t part of his job description. He was subsequently fired according to the lawsuit, due to discriminatory biases. The company stated that he was fired for being late to work.
The lawsuit seeks back wages and damages.
