News reports that the city of Savannah, Georgia is being sued for age discrimination. The city has denied the charges.
The age discrimination claim is based on allegations that the city failed to hire a 73-year-old man who requested a lower salary and instead hired a 48-year-old man who asked for $15,000 more. The older gentleman asserted that he was not hired due to his age, despite his allegedly having significantly more experience.
The Age Discrimination in Employment Act (ADEA) protects certain employees and applicants who are at least 40-years-old from discrimination on the basis of age in hiring, promotion, discharge, compensation, or terms, conditions or privileges of employment.
When faced with allegations of age discrimination, employers may offer rationale for their decision to fire, not hire, or not promote an older worker. The employee may challenge that – asserting that it is “pretext” for a discriminatory reason.
