Workers' Compensation Benefits

Georgia Workers' Compensation is a state accident insurance program designed to provide income and medical benefits to employees who sustain work-related injuries or illnesses. This program is a no-fault system, entitling employees to these benefits even if they caused the accident which resulted in their injury. While giving your employer notice of your work injury is a necessary step, it is only by filing a legal claim with the Georgia Board of Workers Compensation that you are fully protected.

There are five different classes of benefits available under the Georgia Workers Compensation Act:

  • Medical Benefits (including diagnosis, treatment, physical therapy, medical devices, and medical mileage);
  • Income Disability Benefits;
  • Permanent Disability Benefits;
  • Vocational Rehabilitation; and
  • Payments to Dependents in Death Cases.

Workers Compensation generally covers all medical expenses of a job-related injury or illness through designated treating doctors. You are entitled to select your choice of doctor from the panel of workers compensation doctors that should be posted at your workplace. You are also entitled to change doctors on the panel once without needing permission. Additionally, if the injury prevents you from returning to work, you are entitled to a fixed weekly income benefit based on a percentage of your regular salary up to a maximum of $500 per week for up to 400 weeks (for catastrophic claims, you may receive lifetime income benefits).

If an authorized treating physician gives you an impairment rating once you've reached maximum medical improvement, then you will also be entitled to additional monies for your permanent disability. We will explain these rights to you, and we will pursue all the benefits available to you.
